What is a Voluntary agreement? (Section 76)

A Section 76 Agreement is a voluntary agreement between a parent/person with parental responsibility and Children's Services.

If agreed it allows a child (or children) to be placed with a family member or foster carer whilst Children’s Services undertake necessary investigations or assessments. Section 76 can also be used to provide a longer period of accommodation for respite or provision of education or medical treatment.

Placement under a Section 76 Agreement may allow a family the opportunity to work with Children's Services to access support to address the concerns raised by Children's Services with a view to avoid court proceedings.

While a child is accommodated under Section 76, you will still retain parental responsibility for the child. However, you have consented to the Local Authority exercising parental responsibility for the day-to-day tasks. The Local Authority should keep you informed about the progress and any updated information concerning your child.

There is no set time limit or maximum duration for accommodation of a child under Section 76.

It is important that if you are asked to sign a Section 76 Agreement, you obtain legal advice to ensure that this is the best option for you and your family.
