If you decided to fly-tip then you are breaking the law and risk a criminal record, with fines of up to £50,000 or 12 months imprisonment. More serious or repeated offences can attract an unlimited fine and up to 5 years imprisonment if convicted in Crown Court.
Rhondda Cynon Taf have the ability to issue a Fixed Penalty Notice of £400 for fly tipping in the following circumstances.
- Where the tipping is ‘small scale’ i.e. 4 to 5 black bags or a single item
- Where the fly tipping is a first offence
- Where the fly tipping is from a domestic property
If the fly tipping is larger than 5 bags, not a first offence or is Commercial Waste then a Fixed Penalty Notice WILL NOT be issued and a the matter will be dealt with through the Court system.
