Right to portability

What is my right?

The right of data portability allows you to obtain and reuse your personal data for your own purposes across different services. It allows you to move, copy or transfer your data easily from one service to another, in a safe and secure way by electronic means. This right does not apply to all data.

When does this right apply?

The right to portability only applies:

  • If you have provided your personal information directly to the Council;
  • Where the Council is processing the information with your consent or for the performance of a contract; and
  • When the processing is carried out by automated means (i.e. without officer involvement)

To which Council services does this right apply?

Currently, there are no Council services to which the right to portability applies. This is because services are not fully automated (i.e. with no input or involvement of Council Officers) and are not carried out with consent / under contract.

Where the right to portability may apply to a service in the future, you will be notified of this right via the service privacy notices.
